Termination

Upon termination, Your right to use the Service will cease immediately.
Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.
United States Legal Compliance
You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
Severability and Waiver Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Translation Interpretation
These Terms and Conditions may have been translated if we have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
Payment Policy
All fees are invoiced by Innovation Learning Systems Inc, a Canadian corporation located in Toronto, Ontario M4M 2E6.
For payments from US & international residents:
- Fees are payable in USD
- Preferred payment is bank wire
- Payment is also accepted via major credit cards or PayPal transfer; plus 5% service fee
For payments from Canadian residents:
- All fees are converted from USD to CAD with applicable taxes (GST/HST) added, payable in CAD
- Preferred CAD payment is via Interac e-mail transfer
- Payment is also accepted via major credit cards or PayPal transfer; plus 5% service fee
All fees are payable in advance and are non-refundable. We do not keep your payment information on file; for your protection and privacy, you will have to submit it again with each new transaction.
Consultation Terms
- If you choose to reschedule a formal session, you must give our office at least 48 hours advance notice in writing (email is fine). If for any reason you do not show up for your appointment without providing us with this notice, you will not receive a refund or credit for that session.
- Please be punctual. If you are more than ten minutes late you will forfeit your appointment. Please check the time carefully – appointments are scheduled in the Eastern (Toronto) time zone.
- Nothing in your session with Yogi Akal is to be construed as or be considered a replacement for medical, legal or financial advice.
- All sessions are strictly confidential and are between you and Yogi Akal only. For your privacy, should you have any details you wish to communicate to Yogi Akal, please wait for your session or email him directly. Do not send them to our office.
- Zoom or MS Teams are the recommended platforms for online sessions. You must send a Zoom or Teams invitation in advance to Yogi Akal.
- Some browsers may work better than others. Any active firewalls or VPNs may interfere with the registration and video streaming process.
- You may record your session. In the event that you forget or there is a recording failure, the session cannot be repeated. It is your responsibility to take notes and/or record it on your end.
- Informal appointments and communications by text, email, WhatsApp and Zoom may be arranged between you and Yogi Akal.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
